Terms & Conditions
1. Copyright and Usage Rights:
Ownership: A Shot Across The Bow retains the copyright to all images and videos created during the shoot.
Client Usage: The client is allowed to use the images (e.g., personal use, social media sharing, printing). Permission for commercial use may be granted with written request.
Photographer Usage: A Shot Across The Bow reserves the right to use the images for our own promotional purposes (e.g., portfolio, website, social media). We further agree to not use photos that would be detrimental to the client (e.g. unflattering photos).
2. Payment Terms:
Retainer/Deposit: The amount of the non-refundable deposit required to secure the booking and when it’s due will be clearly specified in the quotation.
Payment Schedule: The payment schedule for the remaining balance (e.g., due before the shoot, upon delivery of images) will be clearly specified in the quotation.
Payment Methods: Accepted payment methods include cash, check, credit card, online transfer.
Late Payment Fees: Late payments shall be subject to a charge of 1% per month after 30 days overdue.
3. Cancellation and Postponement:
Client Cancellation: Cancellations made prior to 7 days before the scheduled shoot shall be subject to a cancellation fee of 10% of the original amount. Cancellations made within 7 days of the scheduled shoot shall not be eligible for a return.
Photographer Cancellation: In very rare circumstances beyond our control it may become necessary for A Shot Across The Bow to cancel a shoot (i.e. illness, emergency). In these cases we will make every effort to keep our commitment (e.g. finding a replacement drone pilot). If the shoot must be cancelled the client will receive a full refund of all payment made.
4. Rescheduling:
We recognize that boating is very weather dependent. Sailboats in particular have a window of wind conditions for optimal and safe operation. We will work with you to reschedule a shoot if forecasted wind speed is below 5 knots or above 25 knots. There will be no additional fees associated with such rescheduling.
5. Delivery of Images:
Delivery Timeframe: We will specify in the quotation when the edited images will be made available for delivery.
Delivery Method: You will be provided with a secure link to view your edited images and videos.
Image Format: Images will be delivered in JPEG format unless otherwise specified in the quotation.
Number of Images and videos: Drone boat photography and videography is subject to a number of variables (number of participants, duration of shoot, sailing and shooting conditions, etc.). We will make every effort to maximize the available content during our post-production process.
6. Model Release (If Applicable):
If we will be photographing people, especially in recognizable locations or for commercial purposes, it is the client’s responsibility to obtain model releases from the individuals being photographed.
7. Liability and Force Majeure:
Liability: A Shot Across The Bow follows safe drone operating procedures. That being said we can not be held accountable for events outside of our control (e.g., equipment malfunction, accidents).
Force Majeure: All parties acknowledge that neither party may be expected to fulfill their obligations in the event of unforeseen circumstances. (e.g., natural disasters, war, pandemics).
8. Travel Expenses:
If travel is required, these costs will be included in the quotation.
9. Client Responsibilities:
The client is responsible for providing necessary information, securing permits for locations, and ensuring a safe working environment.
10. Artistic Style:
A Shot Across The Bow will make every effort to take client preferences into account. However the final images will be edited according to our professional judgment and artistic style.
11. Governing Law:
This agreement shall be governed by the laws of the province of Ontario.
